Uyghur Forced Labor Prevention Act, Pub. L. 117-78, § 3 (rebuttable presumption); FLETF UFLPA Entity List (Federal Register notices)

UFLPA Entity List compliance for importers

Section 3(a): goods mined, produced, or manufactured wholly or in part in Xinjiang, or by an entity on the UFLPA Entity List, are presumed to be made with forced labor and prohibited from entry under 19 U.S.C. 1307, unless the importer rebuts the presumption by clear and convincing evidence and meets the due-diligence and response requirements. source

Who it reaches

Importers of record, customs brokers, and any buyer whose federal contract or award flows down supply-chain forced-labor terms.

The record the rule expects

The UFLPA Entity List read by exact printed entity name with the Federal Register notice date; the Consolidated Screening List and DoD 1260H rows under the same name; CBP's WRO and EAPA pages are not machine-readable and are listed as not read — record your hand read of them beside the receipt.

Questions readers ask

Does a clean Entity List read rebut the presumption?

No. The presumption also attaches to Xinjiang origin regardless of the list, and rebuttal is an evidentiary showing to CBP. The receipt records the list read, dated.

How often does the list change?

By Federal Register notice, several times a year. The source-change log shows each held-file change with its date.
